The Commission has adopted certain rules to protect consumers and businesses, for not receiving unwanted messages in electronic equipment such as wireless, on cell phones. The Commission began the process of setting standards, following the instructions outlined in the Congress Control Law of Non-Solicited Pornography and Marketing of 2003 (Ley CAN-SPAM, for its acronym in English). Congress passed the CAN-SPAM Act to control the rapid increase in unwanted commercial electronic messages.
The CAN-SPAM Act requires the Federal Communications Commission to establish rules relating to trade some emails and text messages sent to wireless devices, like cell phones, for example; emails not generally. Specifically, Section 14 of the CAN-SPAM Act requires the Commission to establish rules to protect consumers, for not receiving "unwanted commercial messages on their cell phones".
